MEMBERSHIP TERMS & CONDITIONS
I will read and familiarise myself with, and others I am responsible for, the below terms & conditions and the Mount Maunganui Jiu Jitsu Student Guide (found on our website/displayed on the wall at the gym/printed leaflet at reception), which includes Mount Maunganui Jiu Jitsu guidelines and procedures.
It is the duty of members to follow and understand Mount Maunganui Jiu Jitsu rules.
Effective 1 January 2026
These Terms & Conditions apply to all members, students, parents/caregivers, and visitors of Mount Maunganui Jiu Jitsu (“MMJJ”, “we”, “us”, “our”).
By enrolling, attending classes, or entering our premises, you agree to these Terms & Conditions.
1. Assumption of Risk & Liability
Brazilian Jiu Jitsu is a physical contact sport that involves inherent risks including, but not limited to, injury, illness, or death.
By participating, you acknowledge and voluntarily accept these risks.
To the fullest extent permitted by New Zealand law, MMJJ, its owners, instructors, staff, and representatives are not liable for injuries or losses arising from participation in training, except where liability cannot be excluded under the Consumer Guarantees Act 1993 or other applicable legislation.
Nothing in this agreement limits your statutory rights under New Zealand law.
2. Health & Medical Responsibility
- You must disclose any relevant medical conditions or injuries prior to training
• You agree to notify MMJJ of any changes in health that may affect training
• MMJJ does not provide medical advice, diagnosis, or treatment
In an emergency, staff will assist where reasonably possible.
📞 For medical emergencies, call 111 immediately.
MMJJ is not responsible for injuries sustained during training or while on the premises, except where required by law.
3. Children & Supervision
- Children must be supervised at all times unless actively participating in a supervised class
• Parents/caregivers are responsible for children while on the premises
• MMJJ is not responsible for injury or harm to children accompanying adult members outside of class time
4. CCTV & Privacy
CCTV cameras operate in shared training and common areas for safety and security purposes.
- No cameras are located in bathrooms or changing areas
• Footage is accessed only by authorised personnel
• CCTV footage is handled in accordance with the Privacy Act 2020
Members may request access to personal information relating to them as permitted by law.
5. Health & Safety, Police Vetting & Criminal Disclosure
Mount Maunganui Jiu Jitsu is committed to providing a safe, respectful, and secure training environment for all members, with particular emphasis on the safety and wellbeing of children and vulnerable persons.
Health & Safety Obligations
- MMJJ operates in accordance with the Health and Safety at Work Act 2015
• Members must follow all safety instructions provided by coaches or staff
• Unsafe behaviour may result in immediate removal from training
Police Vetting
- All instructors and staff working with or around children are police vetted
• Vetting is conducted in accordance with New Zealand legislation and safeguarding best practice
• Police vetting may be renewed periodically at MMJJ’s discretion
Criminal Record Disclosure
- Staff and instructors must disclose any relevant criminal convictions or charges
• Failure to disclose, or conduct that places members at risk, may result in immediate suspension or termination.
• MMJJ reserves the right to refuse or terminate engagement where criminal history impacts safety, trust, or suitability
Member Conduct & Safety
- Behaviour threatening the physical or emotional safety of members will not be tolerated
• MMJJ may remove, suspend, or permanently ban any individual deemed to pose a safety risk
6. Membership, Payments & Account Information
- All memberships are billed via automatic weekly payments through GYMDESK
• A valid payment method is required at all times
• Memberships renew week-to-week unless cancelled in writing
• Members are responsible for keeping all billing and account details up to date

Account Responsibility
Members must maintain:
• A valid payment method
• A valid email address
• Current contact information (phone number and address)
• Any other required personal information
Members may receive automated or manual communications regarding payment issues, outstanding balances, or account matters.
Failure to keep account details current may result in training disruption, late fees, suspension, or termination.
Email & Communications
- Email is MMJJ’s primary method of communication
• Members must regularly check email, including SPAM/Junk folders
• MMJJ is not responsible for missed communications

7. New Member Registration Fees
A one-time registration fee applies:
• Adults: $25
• Children: $15
Applies to:
• All new registrations
• Members rejoining after cancellation
Registration fees are non-refundable except where required by law. New member registration fee will be attached to first membership payment
8. Late Payments & Delinquent Accounts
- Payments overdue by 7 days may incur a $1 per-day late fee
• Failed payments trigger automated notifications
• Continued non-payment may result in suspension or termination
9. Membership Freeze (Hold) Policy
- Minimum freeze: 2 weeks
• Maximum freeze: 8 weeks per membership year
• $25 administration fee per freeze
• 14 days’ written notice required
• Freezes cannot be backdated
• Members may not train or attend open mats while on hold
10. Medical Freeze (Exception)
- Requires a valid NZ medical certificate
- May exceed the annual limit if medically necessary
- A restart fee of $25 applies when returning from medical hold
10. Cancellations
- 14 days’ written notice required
• Non-attendance does not cancel membership
• Training and open mats must cease once notice period ends
11. Uniform & Equipment
- Ranked rash guards required
• Approved fight shorts only (no pockets, zips, or hard elements)
• No under-the-buttocks shorts or tights permitted (mid-thigh minimum length)
• No cropped tops or topless training
• Children must wear belts during No-Gi
12. Grading Updates – Children
- Belts and stripes are not awarded for attendance alone
• Progression is based on skill, behaviour, understanding, and effort
• Children not progressing will not receive stripes or belts
• Children training more, competing, or progressing faster may be promoted ahead of peers
• All grading decisions are made by MMJJ coaches and are final
13. Code of Conduct
Unsafe, abusive, or damaging behaviour may result in:
• Suspension
• Termination
• Permanent ban
14. Media & Photography
MMJJ may photograph or film classes for promotional purposes.
Members may opt out at any time.
15. Lost, Stolen, or Damaged Property
MMJJ is not responsible for personal property.
Theft or damage may result in termination and prosecution.
16. Visitors, Open Mats & External Members
- Open mats are member-organised
• External members may be restricted
• Active BJJ membership required
17. Pandemics, Closures & Public Holidays
Classes may be adjusted. Refunds not guaranteed unless required by law.
18. Price Changes & Services
Prices and schedules may change with reasonable notice.
19. Competitions & Representation
- Coach notification required
• Competitors must represent MMJJ through approved apparel
• Behaviour must reflect club values
20. Conducting Business Within the Gym
No BJJ-related business may be conducted without written approval.
21. Opening or Operating a Jiu Jitsu Gym
Black belts may not open or operate a gym within 10km of MMJJ without written consent.
22. Termination by MMJJ
MMJJ may terminate membership immediately for policy breaches.
23. Amendments
Terms may be updated at any time. Continued membership constitutes acceptance.
24. Governing Law
These Terms & Conditions are governed by the laws of New Zealand.
